What about dogs who get lose and nip someone in fear, like a rescuer or animal control officer?

Lawmaker Wants To Make Dog Bites Felonious

OKLAHOMA CITY — One state lawmaker is promising to change a law in the name of protecting residents from dangerous dogs.
State Rep. Paul Wesselhoft is proposing a bill that would make the first dog bite a felony. If his bill were to become law, offenders could face 20 days in jail and a $10,000 fine.
The proposal would apply to dogs who leave their owner’s property.
Wesselhoft has tried before to get pit bulls banned, but he said this bill is different because it is not breed-specific.
“We’re losing lives out there because of these attacks. I mean, there’s something wrong in Oklahoma when a woman goes out to get her mail, and she doesn’t come back,” he said.
