I gave her some legal info and got some info form her to see if I can help her. The details of this case are still perplexing. I can't understand how if a report was made, nothing has been done about it by authorities. Its such a good case against this man. Here are some more facts you should know! Since the "incident" she has noticed the man on her property fixing his fence, and mowing grass and other such stuff. Very odd behavior!
I had a few questions and I may be able to help you. First of all, do you know the type of weapon used? AR-15 (russian assault rifle)
Was this man on his own property and the dog fenced on yours? Yes, Man was outside on HIS property. Dog was found dead on our property with seven wounds to her butt, chest and head
Any idea what the distance was he shot from? NO
Where was the dog when you came home? By our adjoining fences dead in the yard
Did the man file a complaint with anyone? Not until the cops showed up after the fact. I'm not sure what he told them.
Did you file a complaint? Yes, sherrif that showed up but he and my husband both talked with him. Sherrif drove onto his property, not ours and did not see the dog
Do you have any other animals on the property that are at risk? At risk of him? Yes since he might poison them etc, but no animals here that are at risk to him, his family, or livestock. All my dogs are ATTS temperament tested too and most are titled (except the rescues)
Would you consider some type of restraining order? Yes, but he has not threatened us and is supposedly moving soon. He filed for divorce on Tuesday and his wife wants the house if she can afford it. Neither of them can afford the home on their own
Does this man have a liscense to carry? I don't know. He was discharged from the Army because of post-traumatic stress disorder. Wife says he doesn't take his meds and he drinks. He currently works for the prison in Gatesville, after losing his last job at a different prison. He is a guard but he's only been at the new prison for less than a month and already has five grievances against him filed by inmates. I don't know what they are though. So, I don't know if he has a gun for work or if prison guards are even allowed to carry weapons like guns inside the prisons.
Is the gun registered? I'm assuming so, I know they joined a gun club. I believe he has the AR and a handgun and a shot gun
How long was the dog on your new property? 36 hours give or take. We got here in the middle of the night/morning since we were driving from SC. The first day was fine, the second day we were here is when she was shot, the day of our closing. We were gone for 58 minutes. When we got here, the movers were here but they didn't see anything except him yeilding a gun around. The movers were frightened because they didn't know anything about a dog and thought this guy was just crazy.
What type of fence was your dog enclosed in? I'll send you a more detailed message on the details but there is a 4 ft field fence topped with 2 rows of barbed wire across all 12 acres and gate access to driveway that was closed. She was enclosed in a chainlink yard that was chained closed when we left. When we arrived home, the other dog was in the yard walking around and the gate to the yard was open backwards, like the dog would have had to pull it toward them. The chain around that gate was unchained and missing. We still have not located the chain. She was found a few hundred yards from the yard. At the closing, the old owner's told me, "The neighbors are scared of your dogs." We laughed it off and asked her why because our dogs are friendly and pose no threat to him or anyone else. They just looked at us with a funny look. We don't know if they had prior knowledge of what he was going to do or what. But it is a weird comment to make, especially probably no more than ten minutes later, he'd be shooting and killing our dog. |  |  |  |  |
